Terms & Conditions for Mail Guard (Anti-Virus & Anti-Spam)

General
  1. The Service is open to all Users who possess a Pacnet Internet account.
  2. Users who have an existing Pacnet Internet access account may apply for the Service online at http://www.pacific.net.sg/mailguard. For Users who do not have an existing Pacnet Internet access account but desire to apply for the Service, must first obtain a Pacnet Internet access account through on-line, mail-in, walk-in or fax-in applications.
  3. Pacnet Internet (S) Limited ("Pacnet Internet") merely distributes software from Symantec Singapore Pte Ltd (the "software") on behalf of Symantec Singapore Pte Ltd for Mail Guard Anti-Virus and accordingly shall not be liable to any claims, damages and expenses or losses arising from or in connection with the use or inability to use the software
  4. The Subscriber shall pay the subscription fees and a one-time activation fee at the applicable rate as indicated on the website or such other rates as may be prescribed by PI from time to time and notified to Subscriber, unless otherwise stated
  5. The is no minimum subscription period for this service unless otherwise stated in your promotion. Should you terminate your account prematurely, you are liable to pay for your subscription charges for the remaining period.
  6. All charges will be billed to the Subscriber's PI email account.
  7. All fees and charges for the Mail Guard service are subject to Goods and Services Tax ("GST").
  8. Pacnet shall not be liable for any loss (whether direct, indirect, incidental, special, or consequential loss including loss of profit, revenue, anticipated savings or business, data or goodwill, value of any equipment including software, claims of third parties and costs and expenses associated with or incidental to any of the foregoing) by reason of User's use or inability to use the Service and/or equipment supplied by Pacnet ("Consequential Losses").
  9. Under normal circumstances, Users can expect the Service to be activated within 1 working day of acceptance of application. However, activation may be delayed due to technical and other reasons. Pacnet shall not be liable for any such delay.
  10. Pacnet reserves the right to amend Mail Guard Terms and Conditions (including, without limitation, the charges and fees herein stated) at any time from time to time and such amended terms and conditions shall be binding on the User upon such amendment coming in to effect, whether the User has been notified of such amendment or not.
  11. The service is provided on an "as-is" basis and all implied warranties (statutory or otherwise) are disclaimed. Pacnet Internet (S) Limited shall not be liable for any loss or damage including loss of data or service interruption, which may result from the use of the Mail Guard service or from any deficiency therein.
  12. All prices are inclusive of GST.
  13. Other terms and conditions apply.
Payment

The User undertakes to make full payment of all subscription and other charges and fees due to Pacnet from time to time.

Suspension
  1. Pacnet may (but subject to any applicable laws, regulations or directions of any relevant authority) suspend the User's account and/or provision of the Service at any time, without limiting any other remedies available to it, on the following grounds:
    1. A reconnection fee shall be payable by the User should the User require the Service to be reactivated. Reactivation will be done only after 1 working day and cannot be immediate.
    2. Pacnet reserves the right to suspend the accounts of Users who fail to make full payment of all outstanding amounts by the due date as stated in any relevant Pacnet invoices.
    3. Users who continue to fail to make full payment of all outstanding amounts despite being served with reminders may have their accounts terminated without further notice, and shall be further liable to pay any premature termination charges applicable.
Termination
  1. All notices to terminate the Service by the User must be sent to Pacnet by email, fax or post only.
  2. If the User terminates his account or the Service, the effective termination date shall be the 1st of the following month. User must send in the termination request by 25th of the month.
  3. If the User is in breach of any of the Mail Guard Terms and Conditions and/or the General Terms and Conditions, Pacnet may at any time thereafter serve a notice upon the User to remedy the breach (if the breach is capable of remedy) within fourteen (14) days from the date of the notice and on the expiration of the said fourteen (14) days period without the breach complained of having been remedied Pacnet shall be entitled to forthwith terminate the User's account and/or provision of the Service without further notice and without limiting any other remedies available to it.
